1. Operator and status of these terms

These terms are intended to govern use of FrameSense with the operator identified below. If any operator field is missing, this document is a draft, cannot be accepted, and must not be used to open public registration.

Operator
Martin Simon
Registration identifier
I?O 11979500
Registered address
Kbelnice 42, 336 01 Letiny, Czech Republic

2. Accounts and access

Account creation may be invitation-only or public, as shown on the registration page. Access is personal to the account, and users must keep sign-in credentials secure, provide accurate account information, and notify the operator of suspected misuse.

Beta functionality may be incomplete, changed, rate-limited, paused, or withdrawn. The operator may restrict access to protect users, media, infrastructure, or the integrity of the test.

A user may use FrameSense on their own behalf. Uploading personal data controlled by an organisation is prohibited until the operator has separately recorded that organisation's legal identity, the user's authority to represent it, and the organisation's written DPA acceptance.

3. The service

FrameSense examines video and audio exports and returns evidence-oriented findings for human review. Sense Fast performs deterministic checks and does not call OpenAI. When available and explicitly requested, Sense Review sends extracted audio for transcription and, when an optional script is supplied, bounded script/transcript comparison windows to OpenAI. Review insights can also send up to six reduced-size sampled video frames, bounded transcript excerpts, completed-check evidence, and selected findings to OpenAI for visual/content advice, chapter suggestions and alternative wording. Optional supporting materials can include PDF, DOCX, TXT, MD, CSV, XLSX and EML files, PNG, JPEG and WebP images, and pasted text. Bounded extracted text, source names and locations, and up to 20 reduced-size images or rendered pages may be included in the same insights request. The original video and complete attachment files are not uploaded to OpenAI as files. Sparse frames and selected document evidence do not provide continuous-video or exhaustive-document coverage.

Where available, projects link related video versions for shot comparison using local visual, audio, and sampled-shot text-recognition features. Matching, source comparisons, and suggestions can be incomplete or uncertain; review the cited evidence and the reported coverage before acting.

Findings are assistive signals, not a guarantee that media is error-free, suitable for publication, or compliant with a contract or law. Users remain responsible for checking the source material and final export.

4. Your content

You retain your rights in uploaded media, scripts, supporting materials, pasted text, and other content. You give the operator a limited right to host, copy, transform, analyse, and delete that content only as needed to provide, secure, and troubleshoot the requested service under these terms and the Privacy Notice.

You must have the rights and permissions needed to upload the content and allow this processing, including for any personal data, voices, music, footage, scripts, or confidential material it contains.

When you act on your own behalf as controller for personal data in uploaded content, the Data Processing Addendum is incorporated into these terms and governs FrameSense's processor role.

5. Acceptable use

  • Do not upload unlawful content or content you are not authorised to process.
  • Do not probe, bypass, overload, disrupt, or reverse engineer security or service controls.
  • Do not share access, automate abusive traffic, evade limits, or misrepresent analysis results.
  • Do not use FrameSense to harm people, infringe rights, or violate applicable law.

6. Media retention and account records

Users select a 24-hour, 7-day, or 30-day media-retention period. The retention clock begins when the analysis first reaches a terminal state, and media becomes unavailable at its stored deadline; physical deletion may finish asynchronously. This includes original attachments, extracted source content and stored shot-preview JPEGs. Findings, quoted evidence, project and version metadata, recognised shot text, and necessary audit, security, billing, and accounting records may remain as described in the Privacy Notice.

7. Plans, credits, and Stripe

Where billing is enabled, Stripe processes checkout and subscription payments. The checkout page must show the price, currency, billing interval, included credits, renewal terms, cancellation route, and applicable taxes before an order is placed. Credits are service-use units, are not money, and have no cash value unless mandatory law says otherwise.

Stripe sandbox payments, subscriptions, invoices, and FrameSense test credits are test records only and create no real purchase. Live billing must remain disabled until the operator identity, tax treatment, cancellation terms, and any mandatory consumer information are complete.

8. Availability and changes

The beta is provided without a service-level commitment. Maintenance, provider incidents, security events, capacity limits, or experimental changes may interrupt it. Material changes to these terms receive a new version and effective date; where required, users will be notified or asked to accept the updated terms.

9. Intellectual property

Except for user content, FrameSense and its software, interface, branding, documentation, and analysis methods remain owned by the operator or its licensors. No rights are granted except the limited right to use FrameSense under these terms.

10. Suspension and termination

Users may stop using FrameSense at any time. The operator may suspend or end access for security, abuse, legal risk, non-payment, breach of these terms, or closure of the service. Data handling after termination remains governed by the Privacy Notice and applicable law.

11. Responsibility and mandatory rights

To the extent permitted by applicable law, the beta is provided as available and without promises that every defect or media issue will be detected. Nothing in these terms excludes or limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or any other liability or consumer right that cannot lawfully be excluded or limited. Each party otherwise remains responsible under applicable law for its own breach, instructions, content, and use of the service.

These terms are governed by the laws of the Czech Republic. Disputes are submitted to the competent courts of the Czech Republic, except that mandatory consumer jurisdiction and choice-of-law protections always prevail. Public registration remains closed until the operator has configured and approved this clause for its legal identity.

12. Contact and complete agreement

Questions about these terms should be sent to framesense@seznam.cz. These terms, the Privacy Notice, and any checkout terms shown before purchase form the agreement governing use of FrameSense, subject to mandatory law.
